This agreement applies to every Menifee Pony Baseball volunteer, including Managers (Head Coaches), Assistant Coaches, Team Parents and Board Members. When you submit the Volunteer Application, you’re confirming that you’ve read and accepted these terms. This page is the official copy for you to read and keep.
1. Responsibilities and conduct. Volunteers take on responsibilities on and off the field, for their team and for the league. Volunteers are expected to show exemplary citizenship and sportsmanship, and to know the Menifee Pony By-Laws, which describe the conduct expected of everyone associated with the league. Volunteers agree to represent their team and the league in a way that is consistent with:
A volunteer who fails to carry out their duties consistent with these rules may be removed from their position by action of the Menifee Pony Board of Directors.
2. Background check and volunteer requirements. Menifee Pony Baseball takes the safety of its players very seriously. Every volunteer must:
The league may update those requirements from season to season. Volunteers are responsible for meeting the requirements in effect when they volunteer.
AT NO TIME may an adult volunteer help players in any game, practice or other team or league event until all of these requirements are complete and the volunteer has been approved.
By submitting the Volunteer Application, the volunteer consents to the investigation and verification of all information in the application. The volunteer also gives Menifee Pony Baseball permission to run a background check, which may include a review of sex offender registries and child abuse and criminal history records (California Penal Code Section 11105.03). Approval depends on the league receiving no disqualifying information from the background check.
3. Health and injury risks. Volunteering with Menifee Pony Baseball may expose volunteers to infectious diseases, including but not limited to MRSA, influenza and COVID-19. League rules and personal habits can lower this risk, but the risk of serious illness and death still exists.
Volunteering also carries a risk of injuries, both serious and minor, from on-field and related activities such as coaching, practicing with players, setting up and maintaining fields and equipment, and attending games and events. These injuries include, but are not limited to: injury to the head, neck or spine (including paralysis); injury to the muscles or skeleton; injury to internal or external organs; loss of or damage to sight, hearing or teeth; death; long- or short-term disability; loss of income, career opportunities or enjoyment of life; pain; and scarring or disfigurement.
By submitting the Volunteer Application, the volunteer KNOWINGLY AND FREELY ASSUMES ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others. The volunteer also agrees to follow the league’s stated and customary terms for protecting against injury and infectious disease. If a volunteer sees any unusual or significant hazard, they agree to stop the activity where it’s safe to do so and tell the nearest league official right away.
4. Release and hold harmless. On behalf of themselves and their heirs, assigns, personal representatives and next of kin, each volunteer HEREBY RELEASES AND HOLDS HARMLESS Menifee Pony, Inc. and Pony Baseball/Softball, Inc., along with their officers, officials, agents and employees, other participants and volunteers, sponsoring agencies, sponsors, advertisers, and, where applicable, the owners and lessors of the premises used for league activities (together, the “RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, INJURY, DISABILITY, DEATH, OR LOSS OR DAMAGE TO PERSON OR PROPERTY, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
5. Acknowledgment. BY SUBMITTING THE VOLUNTEER APPLICATION, THE VOLUNTEER CONFIRMS THAT THEY HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT THEY ARE GIVING UP SUBSTANTIAL RIGHTS, AND ACCEPT IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
